Payment:
A 15% Buyers
Fee will be added to the purchase price of all items auctioned off.
Payment in full for all purchases must be received by the end of
the day of the auction. Successful phone and left bids must
be paid in full by the Wednesday following the sale. Otherwise,
we retain the right to cancel the sale. We accept cash, cashiers
checks, wire transfers and Mastercard and Visa. Two forms of
identification, one being a valid California Drivers License will be
required for all California checks. All checks must be cleared by
the bank prior to the release of purchases. The seller reserves
the right to refuse any form of payment other than cash from a buyer.
Bidder Registration/Resale
#'s: In order to bid at auction, purchasers are required to have
a bidder number which is assigned only after registration giving full
name, address and phone number. We are required to charge sales tax
on all purchases unless we are provided with a completed resale certificate
or the items are to be shipped out of state. We do reserve the right
to refuse bids.
Phone/Left
Bids: While we will do our best to execute any telephone
or left bids on your behalf, we are not liable for a failure to execute.
It is in your best interest to personally bid in person or have a representative
bid for you.
All purchases
must be removed by 5:00, 6 days after the auction . Any items
remaining after that date will incur a $50 a day per lot storage
fee which must be paid in order to receive your items.
There are no exceptions to this policy. Removal of items shall
be at the expense, liability and risk of the purchaser. We do not handle
any shipping requirements, though we can recommend shippers to you.
We will have helpers available from Wednesday to Saturday, following
the sale, to assist with loading. After these dates, we
will not have handlers available to help you lift or load material.
We will take appointments on Monday, the following week, with your own
loaders. We will provide one check-out man only.
Removal
of Items: All items must absolutely
be removed within two weeks after the auction, or else they will be
removed to a separate storage area and all transfer costs and storage
fees will become the debt of the purchaser. All items purchased
may be picked up once payment has cleared our bank. Generally, items
paid for with cash, Mastercard or Visa may be picked up starting on
Tuesday,, between the hours of noon to 5:00 p.m. Items paid for by check
will be available for pick-up starting on Wednesday, between the hours
of 12:00 a.m. and 5:00 p.m. Please note that all payments must clear
our bank before removal of items is possible.
Condition
of Items Sold/Description: The auctioneer
shall not be responsible for the description, authenticity, genuineness
of, any defect in a lot, or suitability of use, and makes no warrant
in connection therewith. We urge you to inspect each item carefully
prior to bidding. No allowance will be made or any sale set aside on
account of any error in cataloguing, or any imperfection not noted.
No deduction will be allowed on any items as all goods being sold at
public auction are sold "as-is" and without recourse. We
urge you to bid carefully. ALL SALES ARE FINAL!!
Dispute
Between Bidders: If any dispute arises between bidders,
the auctioneer may decide the same or may immediately put the item up
for sale again, and sell to the highest bidder. The decision of the
auctioneer shall be final and absolute.
Addition
to/Withdrawal from Sale: The auctioneer
reserves the right to withdraw any of the items from the sale, or to
sell any items not listed. In addition, the auctioneer reserves the
right to group two or more lots together, or to break one lot into two
or more. Wherever the best interest of the seller will be served, the
auctioneer reserves the right to change lots as needed.
Personal
and Property Risk: Persons attending the
preview, auction, or the removal of items assume all risks of damage
or loss to person and property, and specifically releases the auctioneer
and Antique Building Material Co. from liability therefore. Neither
the auctioneer nor his principal shall be liable by reason of any defect
in or condition of the premises in which the sale is held, or for any
negligence of its employees.
Reserves: The
auctioneer reserves the right to reject any and all bids. On lots
where there is a reserve, the auctioneer reserves the right to "pass" or
not sell the item, or bid on behalf of the consignor.
Sale
by Estimated Count, Weight or Measure:
Where items are to be sold by estimated count, measure, or weight, the
purchaser will be billed and required to pay for the estimated count,
measure or weight. If, when delivered, any shortage exists, the purchaser
will receive a pro-rated refund. If an excess occurs, the purchaser
is required to take and pay for any additional pieces at a pro-rated
amount. Please note that any discrepancies in quantity/weight
must be brought to our attention within one week of the sale date in
order to make corrections. We urge you to verify all measurements
prior to bidding on any lot.
Records:
The record of the auction kept by Antique Building Material Co. will
be taken as final in the event of any dispute.
Additional
Terms and Conditions: Additional terms
and conditions noted by the auctioneer prior to and during the auction
will apply to any purchase made during the auction. By bidding on an
item, a bidder is acknowledging and accepting such terms.
